Terms and Conditions

Welcome to PhotoVerse Studio! These terms and conditions outline the rules and regulations for the use of PhotoVerse Studio's Services, located at 1200 5th Ave, Suite 800, Seattle, WA 98101.

By accessing this website and/or engaging our photography services, we assume you accept these terms and conditions in full. Do not continue to use PhotoVerse Studio's services if you do not accept all of the terms and conditions stated on this page.

1. Service Usage

PhotoVerse Studio provides professional photography services including, but not limited to, portraits, wedding photography, event photography, commercial photography, real estate photography, and product photography. By using our services, you agree to:

• Provide accurate and complete information when booking a photography session.
• Comply with all instructions and guidelines provided by PhotoVerse Studio during the photography session.
• Respect the studio's equipment and property.
• Use the photographs provided by PhotoVerse Studio only for the purposes agreed upon in the service contract.

2. Payment Terms

Payment for PhotoVerse Studio's services is due as follows:

• A non-refundable deposit of 25% is required upon booking to secure your session date and time.
• The remaining balance is due upon completion of the photography session, unless otherwise agreed upon in writing.
• We accept payments via credit card, debit card, cash, and check.
• Late payments may be subject to a late fee of 5% of the total invoice amount per month.
• Prices are subject to change without notice, but confirmed bookings will honor the pricing agreed upon at the time of booking.

3. Intellectual Property

All photographs taken by PhotoVerse Studio are the intellectual property of PhotoVerse Studio. The client receives a license to use the photographs for personal or commercial purposes, as agreed upon in the service contract. PhotoVerse Studio retains the copyright to all photographs and may use them for promotional purposes, including but not limited to, website display, social media, and marketing materials. The client may not:

• Alter or modify the photographs without written permission from PhotoVerse Studio.
• Resell or redistribute the photographs.
• Use the photographs for any illegal or unauthorized purpose.

For commercial photography, specific usage rights and licensing agreements will be detailed in a separate contract tailored to the project's needs, outlining the scope, duration, and media in which the images can be used.

4. Liability

PhotoVerse Studio is not liable for any loss, damage, or injury sustained during a photography session, except in cases of gross negligence or willful misconduct. We take reasonable precautions to ensure the safety of our clients and equipment, but we cannot be held responsible for unforeseen circumstances, including but not limited to:

• Accidents or injuries.
• Loss or damage to personal belongings.
• Weather-related delays or cancellations.
• Equipment malfunction.

In the event of an equipment malfunction or other unforeseen circumstances that prevent PhotoVerse Studio from fulfilling its obligations, our liability is limited to a refund of any payments made by the client. We will also make reasonable efforts to reschedule the photography session at a mutually convenient time.

5. Cancellation and Rescheduling

If you need to cancel or reschedule your photography session, please notify PhotoVerse Studio at least 72 hours in advance. Cancellations made less than 72 hours before the scheduled session may result in forfeiture of the non-refundable deposit. Rescheduling is subject to availability.

PhotoVerse Studio reserves the right to cancel or reschedule a photography session due to unforeseen circumstances, such as illness, inclement weather, or equipment malfunction. In such cases, we will provide the client with a full refund of any payments made, or offer to reschedule the session at a mutually convenient time.

6. Image Delivery and Archiving

Edited digital images will be delivered to the client within 2-4 weeks of the photography session, depending on the complexity of the project. Images will be delivered via a secure online gallery, where the client can download the high-resolution files.

PhotoVerse Studio will archive the client's images for a period of one year. After one year, we cannot guarantee the availability of the images. It is the client's responsibility to download and back up their images.

7. Model Release

For portrait and commercial photography, PhotoVerse Studio requires a signed model release from all individuals appearing in the photographs. This release grants PhotoVerse Studio the right to use the images for promotional purposes, as described above.

If the client is unwilling to sign a model release, PhotoVerse Studio reserves the right to refuse service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Washington. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts in King County, Washington.

9. Changes to Terms and Conditions

PhotoVerse Studio reserves the right to modify these terms and conditions at any time without prior notice. It is the client's responsibility to review these terms and conditions periodically for changes. Your continued use of our services after any modifications constitutes acceptance of the updated terms and conditions.
